Information about the protection of personal data pursuant to Regulation (EU) 2016/679 (“GDPR“)
The Regulation (EU) 2016/679 („GDPR“) provides for the discipline aimed at protecting individuals and other subjects with respect to the processing of personal data. Pursuant to the
aforementioned legislation, the processing of your personal data will be based on principles of correctness, lawfulness, transparency and protection of your privacy and your rights. The
company Benvivendo s.r.l. di B.H. Forstner e G. Bartolini, with registered offices at A. Cortesi 22 – 06059 Todi (PG), Legal Representative – Bartolini Gabriele, A. Cortesi 22, 06059 Todi (PG), VAT 03030650547 hereinafter, the „Company“), as data controller, provides you with the following information pursuant to art. 13 of the GDPR:
1. Purposes and methods of data processing
Your personal data is collected only from us, both when registering on the website www.gabettitodi.com and when entering into the contract, and will be processed exclusively
for purposes strictly connected and instrumental to the fulfillment of the obligations inherent to the relations with the Company, in particular:
a. for entering personal data in the company’s IT databases;
b. for accounting and billing purposes;
c. for the management of receipts and payments;
d. to fulfill the obligations provided for by civil and fiscal law, by regulations, by European Community legislation.
The processing of personal data will be carried out through paper and computer supports by the owner, the manager / managers and the persons in charge with the observance
of each precautionary measure, which guarantees its security and confidentiality.
2. Nature of data collection and consequences of failure to provide data
The legal bases of the processing, depending on the case, may be your consent, the execution of a contract of which you are part or the fulfillment of legal obligations to which
the Company is subjected as Data Controller. The provision of your personal data is optional, but failure to do so could make it impossible for us to establish the relationship or
fulfill contractual obligations or, in general, fulfill legal obligations.
3. Communication and disclosure of data
Your personal data, for the purposes of the execution of the contract and for the purposes indicated above, may be disclosed to:
physical and legal persons (legal, administrative, tax, auditing, courier and freight forwarding firms, data processing center etc.) used by the owner for the purpose
of fulfilling administrative, accounting, commercial and management obligations;
banks for the management of receipts and payments;
factoring or debt collection companies;
our collaborators and specially appointed employees and within the scope of their duties.
Any communication will concern only the data that are necessary for the purposes described above. Your personal data will be stored on servers located within the European
Union; the Company does not transfer personal data to countries located outside the European Union.
4. Retention time
Your personal data will be kept for the entire duration of your relationship with the Company. After the termination of the relationship, the Company will keep the personal data
relating to the execution of the contract for the fulfillment of the contractual and legal obligations, also of a fiscal nature. Subsequently, the personal data relating to the
execution of the contract will be kept for a period not exceeding the statute of limitations provided by the law for possibly enforcing or defending a right in court.
5. Rights of the interested party
At any time you can exercise your rights towards the Data Controller, pursuant to articles 15 – 22 of the GDPR, which for your convenience we summarize below. In particular,
you have the right:
to obtain the termination of the treatment in the cases in which your personal data are processed for direct marketing purposes, also in relation to services identical
to those already purchased by our Company (opposition right);
to obtain information in relation to the purposes for which your personal data are processed, to the period of processing and to the subjects to whom the data are
communicated (access right);
to obtain the rectification or integration of inaccurate personal data concerning you (right of rectification);
to obtain the cancellation of the personal data concerning you in the following cases (a) the data are no longer necessary for the purposes for which they were
collected; (b) You have withdrawn your consent to the processing of data if they are processed on the basis of your consent; (c) You have objected to the processing
of personal data concerning you if they are held for a legitimate interest of ours; or (d) the processing of your personal data does not comply with the law. However,
we inform you that the retention of personal data by the Company is lawful if it is necessary to enable it to fulfill a legal obligation or to ascertain, exercise or defend
a right in court (cancellation right);
to obtain that the personal data concerning you are only stored without any other use being made of them in the following cases (a) you contest the accuracy of the
personal data, for the period necessary to allow us to verify the accuracy of such personal data ; (b) the processing is unlawful but you still oppose the deletion of
personal data on our part; (c) personal data is necessary for the verification, exercise or defense of a right in court; (d) you have objected to the processing and are
awaiting verification regarding the possible prevalence of our legitimate reasons for processing compared to those of the interested party (limitation right);
to receive in a format of common use, readable by an automatic and interoperable device, the personal data concerning you processed by automated means, if they
are processed by contract or on the basis of your consent (portability right).
Finally, we remind you that you have the right to contact the Guarantor for the protection of personal data (Piazza di Monte Citorio, 121 – 00186 Rome RM) to assert your rights
in relation to the processing of your personal data. Any request addressed to the owner or manager can also be sent by registered letter, fax or e-mail through the references
below.
